Temecula Holiday Checkpoints Lead to DUI Arrests

Law enforcement set up and conducted a DUI checkpoint prior to Christmas, and several people were arrested. There were 3504 vehicles that drove through the checkpoint and 2960 got screened, looking for license violations and any signs of impairment. At any DUI checkpoint, there are specific requirements that must be followed for it to be legal. For example, it is not legal to use any profiling when pulling over drivers.

During this recent traffic stop, 44 vehicles were taken to the secondary inspection and 20 drivers had field sobriety tests administered. Most people don't realize that you are not required to agree to field sobriety testing under state law, although you are required to comply with chemical testing for blood alcohol content. The purpose of field sobriety testing is to get probable cause for an arrest. The tests are highly subjective and the most accurate, the Horizontal Gaze Nystagmus, according to the National Highway Traffic Safety Administration, is only 77% accurate when measured against real alcohol intoxication. There are a number of factors that could impact the results of your tests, including nervousness, understanding of commands, weather conditions, roadside conditions and general health.
